EU Court Says CBD Products Can’t Be Labeled Organic

The European Court of Justice, the EU’s highest court, ruled this week that CBD-infused edibles and foods can’t be labeled organic because the bloc has not yet authorized the sale of CBD products, DW reports.

Currently, CBD is classified as a “novel food” in the EU, which requires a safety check and official authorization before it can be marketed for sale. The court noted that there is no authorization for CBD, although it is widely available as a wellness product in the form of edibles, capsules, and oils.

The court argued that allowing such products to use an organic label could mislead consumers into believing that the products were authorized.

The case was referred to the court by France’s Council of State, where a hemp business association challenged the organic label restrictions.

Meanwhile, the EU Council voted last month in favor of a whole-plant hemp framework that would harmonize hemp regulations and discrepancies across the bloc’s member states.
