Majority of Massachusetts Municipalities Allowing Adult-Use Cannabis Delivery; 13 Have Imposed Bans 

Thirteen Massachusetts municipalities have imposed a ban on cannabis delivery, while 351 cities and towns are permitting adult-use cannabis delivery, according to data outlined in the Cannabis Control Commission recently launched Municipal Zoning Tracker. Delivery services were permitted under legislation signed by Gov. Maura Healey (D) in April, which also allows towns and cities to opt out of the service; however, medical cannabis delivery is permitted throughout the state by law. 

The tracker also outlines which municipalities allow adult use cannabis sales and social cannabis consumption zoning. So far none of the 351 cities or towns have approved zoning for social use, according to the tracker. 

Under the law, cities and towns that ban cannabis delivery services for up to two years, and 11 municipalities have imposed the maximum ban, while two have imposed a one-year prohibition, according to the tracker. 

Massachusetts Cannabis Control Commission Executive Director Travis Ahern told WWLP that the “Delivery businesses are not only safe and discrete, but also offer tangible local benefits, like revenue from the local option tax from Delivery Operators.” 

Currently, Massachusetts has licensed eight Marijuana Couriers and 17 Marijuana Delivery Operators, which have facilitated or directly generated about $74 million in gross sales since June 2021, according to state data outlined by WWLP. The businesses employ 324 delivery agents.
